For The Abandonment & Vacation of a Portion of Bayville Road

WHEREAS, The Delaware Department of Transportation, (DelDOT) has custody and control of Bayville Road; and
WHEREAS, the owners of The Overlook subdivision, have petitioned DelDOT to consider the vacation and abandonment a portion of Bayville Road which will be replaced by a new entrance road from the remaining portion
of Bayville Road, measuring approximately 450 linear feet +/-, which has ceased to be of necessity to the highway system.
WHEREAS, Title 17, Section 1311 of the Delaware Code grants DelDOT the authority to vacate and abandon public roads or parts thereof, ceasing to be of necessity to the general highway system.
NOW, THEREFORE, BE IT RESOLVED by DelDOT that a Public Hearing shall be held with regard to the proposed vacation and abandonment of a portion Bayville Road. The hearing will be held at the DelDOT South District Administration Building (conference room), 23697 DuPont Boulevard (located at the intersection of County Road No. 431 & U.S. Route 113), Georgetown, DE, on Wednesday, September 10, 2014 at 10:00 am.
Public comments concerning this matter will be received at this time.
