For The Abandonment & Vacation of an Unimproved
Portion of Channel Road

WHEREAS, The Delaware Department of Transportation, (DelDOT) has custody and control of unimproved portion of Channel Road; and

WHEREAS, the adjacent property owners, has petitioned DelDOT to consider the vacation and abandonment of the unimproved portion of Channel Road. The area is referenced as follows: beginning at the point of intersection of the northern right-of-way line of Lore Avenue and the unimproved portion of Channel Road, proceeding in a northerly direction, approximately 120 +/- linear feet which has ceased to be of necessity to the highway system.

WHEREAS, Title 17, Section 1311 of the Delaware Code grants DelDOT the authority to vacate and abandon public roads or parts thereof, ceasing to be of necessity to the general highway system.

NOW, THEREFORE, BE IT RESOLVED by DelDOT that a Public Hearing shall be held with regard to the proposed vacation and abandonment of a portion of unimproved Channel Road. The hearing will be held at the Canal District DelDOT Administration Building, (Basement conference room), located at 250 Bear-Christiana Road, Bear, Delaware on Tuesday, February 10, 2009 at 10:00 a.m. Public comments concerning this matter will be received at this time.

Comments will be received during the workshop or can be mailed to DelDOT Public Relations, P.O. Box 778, Dover, DE 19903.
