Forms & Applications For Out-Of-State Firms
Effective February 28, 2011, the United States Department of Transportation (USDOT) enacted new regulations in regard to Interstate Certification for Disadvantaged Business Enterprise (DBE) applicants (section 26.85). These regulations were designed to decrease barriers to certification for out-of-state firms and to enhance the ability of DBE participants to pursue business opportunities outside of their home states. Nationwide compliance with the revised section 26.85 becomes mandatory January 1, 2012.

Any firm currently certified as a DBE by their home state Unified Certification Program may apply for DelDOT DBE certification. A detailed description of all application forms required by DelDOT is listed in the Interstate Certification Affidavit, which must be signed and submitted to DelDOT along with the application package. Once a complete application package is received, DelDOT has 60 days to review and determine whether it has specific objections to the firm's eligibility and to communicate those objections to the firm.

If DelDOT believes that an out-of-state applicant firm is ineligible, they will state the specific reasons or objections to the firm's eligibility. The firm then has the opportunity to respond and present information or arguments concerning the specific objections that DelDOT has made. As with other pre-certification regulations, the firm, rather than the certifying agency, has the burden of proof with respect to a response to the specific issues raised by DelDOT's objections. The final decision maker at DelDOT will be someone who is knowledgeable about the eligibility provisions of the DBE rule.
